提供相關證據Supporting Evidence重要性

根據Home Office Case Worker Guidance - Evidential Flexibility，歸納出以下幾個原因：

1️⃣Burden of Proof (舉證責任)

「The burden of proof is on the applicant to show that they meet the eligibility requirements of the rules」

💡關於申請人是否合乎資格，舉證責任在於申請人💡

舉證包括上述關係證明，需要長期照顧證明等等。如果你有任何證據，想納入申請被Home Office考慮，你作為申請人係有責任主動提供證據。

💬咁如果冇主動提供，等Home Office問我先提供，又得唔得呢?

2️⃣No requirement to contact (冇聯繫申請人嘅責任)

「If evidence is missing or inadequate, you do not have to offer the applicant an opportunity to prove they meet the requirement in a different way」

💡如果證據沒有提供或者不充足，Home Office係冇需要給予機會申請人解釋，點解佢能夠符合申請要求💡

簡單講，你作為申請人，冇提供有關證明，或者提供嘅證據唔充分，Home Office係冇需要給予申請人另一次機會補交文件。

💬如果Home Office要求我10日內提交補充文件，咁應該點算?

3️⃣Process to request information 要求補交文件程序

如果申請人覺得唔夠時間準備，係可以提供理由，要求延長時限(Extension)。

💡但如果你10日內冇提交補充文件亦冇回覆，Home Office就會基於已提交嘅證據，去作出決定💡

「If you do not receive any additional information by the 10 day deadline, and no extension has been agreed, you should make a decision on the basis of available information」

。

所以，與其等Home Office問你先遞交證據支持申請，各位申請人應該起申請嘅時候，準備好所有相關證據，一次過遞交晒俾Home Office作考慮。
